Saint-Josse: claim against tax by half the owners of prostitution window apartments

Regarding the 2016 taxation of the prostitution window apartments in Saint-Josse-ten-Noode, 37 owners out of 68 filed a legal complaint at the municipality at the end of February, according to a reply to a question of topicality formulated on Monday evening at the town council by the mayor Emir Kir.

Concerning the coming into effect of the October 2016 tax, the protest procedure has no suspensive effect and interest on late payment can be claimed. Thus, the introduction of a claim does not relieve the debtor from his obligation to pay.

However, the recovery and limitation period are suspended. Therefore the municipality cannot enforce a compulsory recovery. If the debtor is successful, the municipality will have to reimburse the amounts paid.

The college will rule on each claim within the legal period of 6 months from receipt.

The tax on prostitution window apartments was increased to 3,000 euros in 2016 from 950 euros in 2015. The mayor said he wanted to pursue a strong policy against human trafficking.
